Doctoral graduate champions kaupapa M膩ori approaches to justice

Dr Eru Findlay, Te Aitanga a Hauiti, Ng膩ti Porou, Ng膩puhi, Ng膩ti Raukawa, is breaking new ground in the field of kaupapa M膩ori justice approaches.

His doctoral research into Ng膩 K艒ti Rangatahi o Aotearoa Marae-Based Youth Courts examines how this innovative judicial model promotes the wellbeing of M膩ori youth and their wh膩nau.

Integration of M膩ori tikanga is prevalent in many facets of Dr Findlay鈥檚 life. Rooted in his upbringing and deep cultural heritage, Dr Findlay鈥檚 work was influenced by strong wh膩nau values.

鈥淢y introduction embodies my ethnic identity and its importance and relevance to me. As a child I was brought up by grandparents whose first language was te reo M膩ori, and who practiced tikanga everywhere they went, and in everything they did. They were my first examples of kaupapa M膩ori approaches. If you entered their whare, you were treated as special guests.鈥

Dr Findlay鈥檚 research serves as a ten-year study into the effects and outcomes of Ng膩 K艒ti Rangatahi. His master鈥檚 research found that Ng膩 K艒ti Rangatahi did reduce offending through social and cultural engagement. Building on this, his PhD explored whether these programmes also improved the health and wellbeing of rangatahi and wh膩nau, and how outcomes could be measured.

Dr Findlay applied findings from the 2003 paper by Ahorangi Taiea Distinguished Professor Graham Hingangaroa Smith, CNZM, FRSNZ, Ng膩ti Apa, Ng膩ti Kahungunu, Te Aitanga a Hauiti, K膩ti M膩moe, titled .

鈥淜aupapa M膩ori approaches the theory that: 'to be M膩ori is the norm鈥. As an analytical approach, kaupapa M膩ori is about thinking critically, including developing a critique of P膩keh膩 constructions and definitions of M膩ori and affirming the importance of M膩ori self-definitions and self-valuations [Smith, 2003]. With regard to Ng膩 K艒ti Rangatahi, it is a response to the Westminster model courthouse-based forms of justice in the Aotearoa New Zealand context.鈥

Dr Findlay鈥檚 approach to his best practice framework was derived from the Te Whare Tapa Wh膩 model, developed by Professor Emeritus Sir Mason Durie, ONZ, KNZM, Ng膩ti Kauwhata, Ng膩ti Raukawa Te Au ki te Tonga, in 1984.

鈥淢膩ori practices refer to 'kawa' or the traditional M膩ori processes enacted at Ng膩 K艒ti Rangatahi. M膩ori spirituality refers to the M膩ori spiritual processes, including karakia, acknowledgment of the deceased, and references to M膩ori Gods. M膩ori relations refers to the interaction between the Ng膩 K艒ti Rangatahi professional, the youth, and the wh膩nau.鈥

He emphasises the importance of cultural identity in addressing social problems like youth offending, drawing on previous research that links negative or absent cultural identity to higher rates of offending.

鈥淎lthough there are incremental signs of successful kaupapa M膩ori approaches in justice reducing M膩ori criminal offending, for example the Iwi Justice Forums, there is still a way to go to reverse the statistics 鈥 statistics that have emerged over decades and may take the same amount of time to reverse. The big question that my thesis did answer was, is te reo M膩ori me 艒na tikanga relevant to vulnerable rangatahi and their wh膩nau, and can it be implemented and taught to them? And the answer is yes.鈥

Dr Findlay hopes other studies will explore how effective kaupapa M膩ori approaches are in justice and other fields, similar to the way his own research explored the topic.

鈥淭o me, Ng膩 K艒ti Rangatahi, conveys that no matter who you are, and what you鈥檝e done, you鈥檙e still part of a wh膩nau, hap奴 and iwi, and as such, are always a part of the M膩ori collective. This perspective should also be conveyed in the broader justice system and the other fields of the Aotearoa New Zealand governmental service system.鈥
